Wilsonart, LLC v. Lopez
In a fatal rear-end crash case, the Fifth District reversed summary judgment for the defendants despite dashcam video that directly contradicted the estate's evidence, and certified whether Florida should recognize a video-evidence exception to its summary judgment standard. The Florida Supreme Court answered no, declining to engraft an ad hoc exception, but simultaneously announced (in In re Amendments to Fla. R. Civ. P. 1.510, SC20-1490) that Florida would prospectively adopt the federal Celotex/Anderson/Matsushita summary judgment standard by rule amendment.
