VME Group International, LLC v. The Grand Condominium Association, Inc.
After plaintiffs' trial counsel withdrew twice and remaining appellate-only counsel suffered an acute medical emergency, the trial court denied a continuance, granted the defense summary judgment motions and entered final judgment after a non-jury trial in which plaintiffs did not appear. The Third DCA held the trial court abused its discretion in denying the continuance and in denying the ensuing rule 1.530 motion for rehearing, and reversed all final judgments.
