The Third District dismissed Rocha's certiorari petition for lack of jurisdiction, holding he failed to demonstrate irreparable harm. Because the state-secrets privilege belongs exclusively to the United States government and Rocha never invoked his plea agreement's pre-publication review procedure, any claimed injury from disclosing purportedly classified information was speculative and too remote to support certiorari, and the compelled discovery was not carte blanche access to irrelevant material.
