The River Front Master Association, Inc. v. North Investment Group, LLC

Case No. 3D2023-1472

A commercial condominium unit owner and its brokerage lessee sued the master association over signage restrictions and were granted leave to amend to plead punitive damages. The Third District reversed, holding the association's alleged conduct \u2014 changing its aesthetic sign policy, removing the lessee's sign, and tinting the storefront windows, even if motivated by a desire to favor a commercial rival \u2014 does not rise to the outrageous, malicious, or wanton conduct required for punitive damages.
