Taylor v. State

Case No. 1D2021-1489

The First DCA affirmed a conviction for aggravated manslaughter of a child by culpable negligence where the defendant bed-shared with her 19-day-old infant while impaired from methamphetamine use, and the infant died from 'unsafe sleep.' The court held that bed-sharing alone, without evidence of impairment or other aggravating factors, would be insufficient to establish culpable negligence, but the combination of bed-sharing with meth impairment and prior warnings was sufficient to survive a motion for judgment of acquittal.
