Taplin Falls, Ltd. v. Brown

Case No. 4D2025-3894

A final judgment in an uncontested landlord-tenant case contained a paragraph giving the landlord 45 days to move for attorney's fees and costs. Three months later, at the fee hearing, the trial court sua sponte struck that paragraph as legally erroneous under rule 1.525 and denied the fee motion as untimely. The Fourth District reversed, holding the court lost authority to substantively modify the judgment once the rule 1.530 rehearing window closed, and that rule 1.540 cannot be used to cure a judicial error based on a mistaken view of the law.
