Star Manufacturing Extraction, LLC v. Leasing Innovations, Incorporated
Star sued Leasing Innovations for civil theft, FDUTPA violations, and unjust enrichment based on upfront fees paid as a precondition to obtaining equipment financing that was never provided. The trial court dismissed for improper forum based on the forum selection clause in the parties' later equipment lease. The Sixth DCA reversed, holding that the clause, which reached only legal actions 'commenced hereunder,' applied only to suits based on the Agreement, and Star's claims rested on pre-Agreement promises.
