Murphy v. Villages at Noah's Landing, Ltd.
Parents of adults with developmental disabilities sued the FHFC-financed Villages at Noah's Landing and related operators for FHA, FDUTPA, fraud, and third-party-beneficiary breach of FHFC financing contracts over alleged misrepresentations about free services and fees. The court dismissed the § 3604(f)(1) FHA count with prejudice, dismissed the Florida third-party-beneficiary contract count without prejudice for failure to identify the contracts, and denied dismissal of the FDUTPA and Florida fraud counts after finding Rule 9(b) particularity satisfied.
