McQueen v. Baskin

Case No. 2D2022-1482

The Second District reversed a final judgment entered for Carole Baskin in Anne McQueen's defamation suit arising from Baskin's YouTube vlog and Big Cat Rescue website posts accusing McQueen of forgery, theft, and embezzlement. The court held the statements were assertions of fact that, if false, would be defamatory (and therefore not protected speech under Florida's Anti-SLAPP statute, § 768.295), and that Baskin was not a 'media defendant' entitled to presuit notice under § 770.01.
