Lee v. Animal Aid, Inc.

After a nonprofit's defamation suit against a former volunteer was resolved in her favor through non-binding arbitration that became final, the volunteer sought attorney's fees under Florida's Anti-SLAPP statute, section 768.295(4). The Fourth District affirmed denial of fees, holding that fee entitlement requires an express ruling that the suit was filed in violation of the Anti-SLAPP statute, and that merely raising Anti-SLAPP without securing a ruling neither creates entitlement nor preserves the issue for appeal.
