JMOR Properties, LLC v. Artist Alley Townhomes, LLC
Counsel filed a certiorari petition challenging an order vacating a clerk's default that contained fabricated and mischaracterized case citations generated by AI software; he explained he had verified and corrected a draft but inadvertently filed the AI's original version. The Fourth District dismissed the petition for lack of jurisdiction and, on order to show cause, referred counsel to the Florida Bar, holding that filing the wrong draft does not excuse the duty to verify every citation and that failing to find the settled contrary authority independently breached the duty of competence.
