In Re: Amendments to Florida Rules of Civil Procedure

Case No. SC2024-0774

The Florida Supreme Court adopted Civil Procedure Rules Committee proposals amending Rules 1.070 (Process), 1.410 (Subpoena), 1.550 (Executions and Final Process), 1.560 (Discovery in Aid of Execution), and 1.730 (Completion of Mediation), effective April 1, 2025. The most consequential change for practitioners is the amendment to Rule 1.730, which eliminates the requirement that counsel for each party sign a court-ordered mediation agreement and instead permits a party representative with full settlement authority under Rule 1.720(c) to sign in place of the party. The remaining amendments modernize archaic terminology across process, subpoena, and execution rules — primarily removing the word "praecipe" and replacing Latin-inflected and overly formal phrasing — with no substantive change to the underlying procedures.
