In re: Amendments to Florida Rule of Criminal Procedure 3.191
The Florida Supreme Court amended Rule of Criminal Procedure 3.191 (Speedy Trial) and Rule 3.134 (Time for Filing Formal Charges) on its own motion. The amendments change the speedy trial clock's starting point from the date of arrest/custody to the date formal charges are filed, make the recapture period mandatory in all cases and extend it from 10 to 30 days, and provide that discharge for a speedy-trial violation under the rule is without prejudice unless the defendant's constitutional speedy trial right was violated, in which case discharge is with prejudice. Rule 3.134 was also amended to add a mechanism releasing a defendant from pretrial restraints if formal charges are not timely filed. Justice Labarga dissented, arguing the changes overrule the formal-arrest standard adopted in Davis v. State and unduly weaken defendants' speedy trial protections.
