In re: Amendments to Florida Rule of Civil Procedure 1.510 and New Florida Rule of Civil Procedure 1.202
On its own motion and after comments and oral argument, the Florida Supreme Court further amended Rule 1.510 (summary judgment) and new Rule 1.202 (conferral before filing motions), effective January 1, 2025. Rule 1.510 now requires the motion be filed consistent with any court-ordered deadlines, a response served no later than 40 days after service of the motion (reduced from 60), and any hearing set at least 10 days after the response deadline unless stipulated or otherwise ordered. Rule 1.202 was revised to list 14 categories of motions exempt from the conferral duty, exempt matters where either the movant or nonmovant is pro se, add an alternative certificate form, and authorize sanctions—including denial of a motion without prejudice—for noncompliance or purposeful evasion of conferral.
