In re: Amendments to Florida Rule of Civil Procedure 1.453

The Florida Supreme Court adopted new Florida Rule of Civil Procedure 1.453, governing how trial courts must handle juror requests for trial transcripts or for readback/playback of trial testimony in civil cases. Readbacks or playbacks may be ordered only after notice to counsel and must occur in open court with all parties present, though the court may respond in writing if parties get an opportunity to place objections on the record. If jurors request transcripts, the court must inform them transcripts are unavailable and that a discretionary readback/playback request may be made, and must instruct jurors to specify particular testimony.
