In re: Amendments to Florida Rule of Civil Procedure 1.351
The Florida Supreme Court adopted the Civil Procedure Rules Committee's proposed amendments to Rule 1.351 governing non-party production without deposition. When a notice of non-party production is served with original process, the subpoena may not issue earlier than 45 days after service on the last-served party, and objections may be served within that 45-day window. The amendments also clarify the 10-day (delivery/e-mail) and 15-day (U.S. mail) waiting periods before a subpoena may issue.
