Gordon V. Vinci and Stella Vinci v. Lake Lizzie Reserve Homeowners Association, Inc.
The Sixth DCA reversed a mandatory injunction entered as part of a settlement-enforcement order because the trial court's order contained no findings whatsoever, in violation of Florida Rule of Civil Procedure 1.610(c)'s requirement that every injunction specify reasons for entry and describe in reasonable detail the acts restrained. The court reaffirmed that clear, definite, and unequivocally sufficient factual findings must support each of the four elements required for a mandatory injunction. Civil practitioners handling HOA enforcement actions and settlement-related injunctions should ensure the trial court makes explicit findings on all four mandatory injunction factors to withstand appellate review.
