Bedoyan v. Samra
After a bifurcated trial establishing an oral 50/50 partnership in a precious-metals business and a bench trial on damages awarding Samra $2.2 million, the Third District affirmed in all respects. It held that the equitable accounting claim failed because the damages award was an adequate legal remedy, the breach of fiduciary duty claim failed because it was not independent of the breach of contract, and that RUPA's buyout provision (\u2014 sections 620.8405(2)(b)2. and 620.8701 \u2014) permits a dissociated partner to sue only the partnership, not a co-partner personally.
