Agency for Health Care Administration v. Payas

Case No. 6D2023-1391

AHCA appealed a circuit court order reducing its Medicaid lien on a minor's medical malpractice settlement and denying AHCA's motion to dismiss for lack of subject matter jurisdiction. The Sixth DCA held that the version of section 409.910(17) in effect when the settlement was approved (2021) governs, so DOAH has exclusive jurisdiction over challenges to AHCA's lien, and the circuit court lacked subject matter jurisdiction.
