The decisions
- Hector Perez Acosta v. Idaymi Martinez-Borges (3rd DCA, October 14, 2026) — Confirms the fugitive disentitlement doctrine can bar a parent's custody appeal where fugitive status, a nexus to the order, and necessity of dismissal are shown. Read it →
- Kennedy v. Kennedy (4th DCA, October 7, 2026) — Holds a judgment incorporating an MSA, ordering compliance, and reserving jurisdiction is a court support order, so the CCPA's 25% cap does not limit alimony withholding. Read it →
- Walters v. Agency for Healthcare Administration (3rd DCA, October 7, 2026) — The 2021 amendment treating cooperative unit interests as real property is not retroactive, so a 2017 decedent's unit was not protected homestead from AHCA's claim. Read it →
- Kennedy v. Kennedy (4th DCA, October 7, 2026) — Same Kennedy decision: the qualifiers in § 1673(b)(1)(A) modify only 'an administrative procedure,' and the court rejected Maryland's contrary Naedel decision. Read it →
- Meb Loan Trust VI v. Isaacs (3rd DCA, October 7, 2026) — An incapacitated record titleholder remains an indispensable foreclosure defendant. The guardian defends but is not substituted, and Rule 1.260 does not apply when incapacity predated suit. Read it →
- Martinez v. Guardia (3rd DCA, October 28, 2026) — Disqualification motions must be reasonably prompt. A recorded mortgage gives constructive notice under § 695.11, and continued litigation plus prejudice can make a motion untimely. Read it →

The practical upshot
- When enforcing alimony, confirm the judgment orders MSA compliance and reserves jurisdiction. Under Kennedy, withholding then is not limited by the CCPA's 25% cap.
- Before asserting homestead protection for a cooperative unit, check the date of death. Walters holds the 2021 amendment does not apply to a 2017 death.
- Check public records early and raise disqualification grounds promptly. Under Martinez, recorded instruments can start the timeliness clock.
