The decisions
- The Waterfront in Naples Condominium Association, Inc. v. Reynolds Ventures, Inc. (6th DCA, August 21, 2026) — In the Sixth District, a timely trial de novo request identifying the arbitration award satisfies rule 1.820(h) without the words 'notice of rejection'; conflict certified with Third and Fourth Districts. - Goldman v. Lewin (3rd DCA, August 26, 2026) — Orders granting leave to add punitive damages need no findings identifying supporting evidence; Cat Cay is superseded by Perlmutter, and filing suit without probable cause alone isn't intentional misconduct. Read it →
- Citizens Property Insurance Corp. v. Nekouee (2nd DCA, August 14, 2026) — Section 627.70152 presuit notice applies to declaratory judgment actions seeking no money, including appraisal-form disputes; the Second District quashed, by certiorari, an order denying dismissal for noncompliance. - Univision Communications, Inc. v. Carlos Enrique Luna Lam (3rd DCA, August 5, 2026) — An order striking an Anti-SLAPP motion under rule 2.515 is not an appealable 'denial' under rule 9.130(a)(3)(J), which has no retroactive effect. Read it →
- In re: Amendments to Florida Rules of Appellate Procedure 9.020 and 9.100 (FL Supreme Court, August 27, 2026) — Effective October 1, 2026, 'lower tribunal' is broadened and rule 9.100 restructured: non-respondent officials who issued the order receive the petition, but later filings only upon electing service. The practical upshot
- Use rule 1.820(h)'s exact wording ('notice of rejection' plus request for trial) in one timely document, and monitor Supreme Court review of the certified conflict.
- For original-proceeding petitions filed on or after October 1, 2026, serve the official who issued the order, and check rule 9.100(b)(4) before serving later filings.
- In Third District punitive damages challenges, target the claimant's proffer rather than absent findings; orders striking Anti-SLAPP motions are not appealable under rule 9.130(a)(3)(J).
