The decisions
- Chandler v. St. Peter's Academy, Inc. (4th DCA, August 19, 2026) — Emailed public records requests are received under UETA when they reach the agency's designated inbox; requesters need not follow up, and willfulness is not required for the relief sought. Read it →
- In re: Amendments to Florida Rules of Appellate Procedure 9.020 and 9.100 (FL Supreme Court, August 27, 2026) — Effective October 1, 'lower tribunal' includes bodies whose action or inaction is challenged; petitions go to the order's issuer, who, if not a respondent, gets later filings only by election. - HM Florida-ORL, LLC v. Secretary of the Florida Department of Business and Professional Regulation (11th Cir., August 4, 2026) — Federal injunctions against enforcing Florida statutes must be limited to complete relief for the plaintiff; the en banc court rejected statewide and overbreadth exceptions to Trump v. CASA. Read it →
- Fish v. Extreme Enterprises of Marion County, Inc. (1st DCA, August 26, 2026) — Guardianship expenses necessary to pursue workers' compensation benefits are reimbursable from the employer/carrier when the incapacity is causally tied to the injury, even if incurred outside JCC proceedings. - Key Haven Associated Enterprises, Inc. v. Florida Department of Environmental Protection (1st DCA, August 26, 2026) — A regulatory takings claim accrues at the government's original final decision prohibiting development; a new permit application decades later does not restart the four-year limitations period. - Loubaton v. Walmart Inc. (S.D. Fla., August 26, 2026) — A federal court held consumer suits against retailers over sales tax charged on exempt goods require exhaustion of § 215.26 refund procedures, regardless of how claims are labeled. Read it →

The practical upshot
- Audit agency email inboxes used for records requests; under Chandler, a request is received on arrival, so the duty to respond can arise before anyone reads it.
- Update service checklists for original-proceeding petitions filed on or after October 1, 2026, under amended rules 9.020 and 9.100, including notices of election.
- Check accrual and exhaustion early: takings claims may run from the original prohibition, not a later denial; tax-overcharge claims may require § 215.26 refund requests first.
